The Singapore High Court entered judgment for US$4 million in favour of RCLC’s client

We are pleased to share that a team led by our Joint Managing Director Remy Choo Zheng Xi and Of Counsel Dickson Chew obtained a successful outcome for our client, Cradle Wealth Solutions Pte. Ltd., in a claim for the sum of US$4,000,000.00 after a 4-day trial in the Singapore High Court.

In a 64-page judgment issued by the Honourable Justice Lee Seiu Kin, the court had the occasion to consider the application of s 94(c) of the Evidence Act as an exception to the parol evidence rule. The court held that where there is a written contract or agreement, s 94(c) of the EA does not preclude the admission of new evidence, in the form of a separate oral agreement constituting a condition precedent, which contradicts, varies, adds to, or subtracts from the terms of the written agreement.

Assessing the evidence at trial, Justice Lee ruled that our client was entitled to the sum of US$4,000,000.00 plus pre- and post-judgment interest at 5.33%, with costs to be agreed or taxed.
